TERMS & CONDITIONS

  1. GUTTER CLEANING:
    Ferrari Gutter Services LLC must be notified within one (1) day after service if you feel there is a problem with your gutter cleaning. If Ferrari Gutter Services LLC is notified of a problem two (2) days or more after service, it will be at Ferrari Gutter Services, LLC discretion to charge a fee to correct the problem.
  2. NEW GUTTERS:
    Ferrari Gutter Services LLC uses sub-contractors for the installation of new gutters and offers a 1 year warranty on labor. Ferrari Gutter Services LLC does not warrant the MERCHANTABILITY OR FITNESS FOR INTENDED PURPOSE of the gutter coil and downspouts. It does acknowledge that any warranties that are available with the products are those of the manufacturer exclusively and not those of Ferrari Gutter Services LLC. This warranty does not cover fire, misuse or abuse, vandalism, impact of foreign objects, including hail, lightning, hurricane, tornado, windstorm, earthquake, or other acts of God. We cannot be held responsible for icicles that may form on the gutter protection products that may result in property damage or personal injury, there are many different reasons that may icicles form (i.e. heat loss, architectural design of roof, position of sun, etc.).
  3. LEAF RELIEF:
    Ferrari Gutter Services LLC does not warrant the MERCHANTABILITY OR FITNESS FOR INTENDED PURPOSE of Leaf Relief. It does acknowledge that any warranties that are available with the products are those of the manufacturer exclusively and not those of Ferrari Gutter Services, LLC. Warranty information for Leaf Relief can be found on the Ply Gem website, www.plygem.com. The warranty will need to be downloaded in a pdf. You can register for the warranty on the website as well. The warranty and the warranty registration will be found under Support on the website.
  4. SCREENING:
    Ferrari Gutter Services LLC does not warrant the MERCHANTABILITY OR FITNESS FOR INTENDED PURPOSE of any type of screening that is installed by Ferrari Gutter Services LLC.
  5. REPAIRS:
    Ferrari Gutter Services LLC does not offer any guarantee of workmanship for re-pitching, repairing or caulking of any existing gutter(s) or offer any guarantee that re-pitching, repairing or caulking will correct the problem of your existing gutter system. Ferrari Gutter Services LLC does not offer any warranty of any kind for re-pitching, repairing or caulking of any existing gutter(s). Ferrari Gutter Services LLC does not offer any guarantee of workmanship or warranty of any kind for any service that are not gutter related (i.e.; roofing, siding, chimney covers, etc.). Warranty and Performance:  Ferrari Gutter Services LLC offers a 1 year labor guarantee on the installation of all new gutter protection products provided by Ferrari Gutter Services LLC. This warranty does not cover fire, misuse or abuse, vandalism, impact of foreign objects, including hail, lightning, hurricane, tornado, windstorm, earthquake, or other acts of God. We cannot be held responsible for icicles that may form on the gutter protection products that may result in property damage or personal injury, there are many different reasons that may icicles form (i.e. heat loss, architectural design of roof, position of sun, etc.).  Ferrari Gutter Services LLC and any and all sub-contractors that Ferrari Gutter Services LLC hires are not liable for consequential damages due to defective product. The materials sold are expressly subject to the condition, if any of the material is determined to be defective in any way, the buyer must notify Ferrari Gutter Services LLC of said defective material within three (3) days after the date of the installation, so that a representative of Ferrari Gutter Services LLC can contact the manufacturer or their representative, and they may inspect said material to determine if it is, in fact defective. If the materials is then determined to be defective, the appropriate steps will be taken by Ferrari Gutter Services LLC, an/or the manufacturer to make the proper adjustments. It is further understood that all credits, replacements, and/or adjustments on material installed are not valid until approved by the owner of Ferrari Gutter Services, LLC in writing. VERBAL APPROVAL OR ACKNOWLEDGEMENT OF CREDIT, ADJUSTMENTS OR REPLACEMENTS OF MATERIAL ARE NOT AUTHORIZED BY FERRARI GUTTER SERVICES, LLC.  Ferrari Gutter Services LLC reserves the right to impose a restocking and remanding charge of any merchandise returned to them. Ferrari Gutter Services LLC further reserves the right to inspect and approve any and all material being returned for credit, which is contained on this invoice.  Ferrari Gutter Services LLC and any and all sub-contractors that Ferrari Gutter Services LLC hires will perform all work in a professional manner using high quality materials and supplies.
  6. Delays:
    Events beyond the control of Ferrari Gutter Services, LLC, such as Acts of Nature, labor strikes, inclement weather, material shortages, delays by local government authorities in issuing or otherwise approving inspections, permitting or other required authorizations for the job, or other events resulting in delays in performance do not constitute abandonment and are not included in calculating time frames for performance by Ferrari Gutter Services LLC. Ferrari Gutter Services LLC and the Buyer(s) have determined that a definite completion date is not of the essence of any service scheduled. Unknown Conditions: Ferrari Gutter Services LLC accepts no responsibility for any damage resulting from structural or other defects in the property at which the installation is carried out. Ferrari Gutter Services LLC is not responsible for remedying structural defects and Buyer acknowledges Ferrari Gutter Services LLC products do not correct or cure structural problems. Ferrari Gutter Services LLC shall not be responsible for (a) any damages arising in whole or in part from strikes, fires, accidents, floods, governmental actions or any other causes beyond control of Ferrari Gutter Services LLC; or (b) unintentional damage to landscaping, gas, electrical wiring, plumbing, telephone installations, collateral or incidental damage to interior walls and personal property, it being understood that Buyer is responsible at its own cost for all preparations, protection and/ or moving of such items prior to Company’s commencement of the work. In the event the Ferrari Gutter Services LLC determines that the work cannot be performed as intended by the parties, due, for example, to incorrect pricing, unforeseen structural defects or pre-existing conditions to the Buyer’s property, Ferrari Gutter Services LLC will not perform any work until the issues are discussed and remedied by the customer.
    Buyer’s Representations:
    Customer represents and warrants that (a) Customer is the owner of the property where the goods and services are being provided; (b) Customer will provide reasonable access to the property and the
    area on which the work is to be performed, including access to electrical outlets as may be required by Ferrari Gutter Services LLC; (c) Customer will be responsible for preparation, moving and
    reinstalling of electrical or telephone wiring, water lines, power lines, plumbing and moving of shrubs and plants as required for performance by Ferrari Gutter Services LLC; and (d) Customer will be responsible for periodic maintenance of all products installed by Ferrari Gutter Services LLC. Customer(s) indemnify and hold Ferrari Gutter Services LLC and its employees, authorized contractors and
    their subcontractors from any claims as to the identification, detection, abatement, encapsulation or removal of mold, asbestos, lead based products or other hazardous substances inside or outside of the  structure being improved unless the Contractor is notified in writing of such hazards prior to beginning work.
  7. PAYMENT:
    This is notice to Customer(s) that if the materials or services are not paid pursuant to the terms agreed upon with Ferrari Gutter Services LLC, then Ferrari Gutter Services LLC reserve the right to file a mechanic’s lien, attest account, or take whatever action is necessary against the property owner where the materials are being used or services were rendered, or any other party that would have control over the funds utilized for the purchase of said material(s) or services rendered. The rights reserved by Ferrari Gutter Services LLC are not only the right to place a mechanic’s lien, but to serve any notice necessary on any party to protect their interests and secure payment for the material(s) sold or services rendered. The purchaser/buyer is aware that payment is due at the time of service, however, as a professional courtesy, Ferrari Gutter Services, LLC extends a NET 7 day payment term. If the services rendered are not paid in full by the 7th day after completion of the job, a LATE FEE of $3.00 will be charged and an additional $3.00 will charged every 7 days until the invoice is paid in full. After the invoice reaches 30 days past due, Ferrari Gutter Services, LLC will take whatever action is necessary and lawful to secure payment, which may result in legal action whereas Ferrari Gutter Services, LLC will seek payment in full, plus costs and interest.
    The Customer also understands that any check that is returned NSF will be assessed a $30 fee. If a check is returned Not Paid, Ferrari Gutter Services LLC will require that payment in full be made via money order, cashier’s check or cash, within 7 days of the returned check. We accept Exact Cash, Checks, Visa & Master Card. Payments made with a Visa or Master Card will assessed a 3% administration fee.
